Terms of Service: Pixie Paws Pets

OVERVIEW

Welcome to Pixie Paws Pets! The terms “we”, “us” and “our” refer to Pixie Paws Pets. Pixie Paws Pets operates this store and website (the “Services”) and is powered by Shopify. By using our Services, you agree to these Terms. If you do not agree, you should not use our Services.

SECTION 1 - AUSTRALIAN CONSUMER LAW (MANDATORY)

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to a refund for the unused portion or compensation for its reduced value. For major failures with goods, you are entitled to choose a refund or replacement. If a failure does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time.

SECTION 2 - RIGHT TO REFUSE SERVICE & ZERO TOLERANCE

We reserve the right to refuse service to anyone for any reason at any time. We maintain a Zero Tolerance Policy toward abusive, threatening, or harassing behaviour. If a customer engages in such behaviour toward our staff, we reserve the right to immediately terminate any active service, cancel orders, or block access to our website without notice.

SECTION 3 - OUR PRODUCTS & BIRD SAFETY

We make every effort to display product colours and images accurately. However, product appearance may differ on your screen.

  • Safety Notice: It is the customer's responsibility to ensure products are suitable for their specific pet. Owners are responsible for constant supervision of their pets with all toys and equipment.
  • Modifications: Descriptions and prices of products are subject to change at any time without notice. We reserve the right to discontinue any product or limit quantities at our discretion.

SECTION 4 - ORDERS & SUBSCRIPTIONS (PARROT RIPPER BOX)

Your order is an offer to purchase and is not accepted until we confirm it.

  • Subscriptions: By signing up for a subscription, you authorize us to charge your nominated payment method at the intervals specified. You may cancel at any time, but cancellations must be made at least 2 days before your next billing date to avoid the next charge.
  • Resale: You warrant that purchases are for personal use only and not for commercial resale.

SECTION 5 - SHIPPING & RISK

All delivery times are estimates only. While we are not liable for carrier delays, we will act in accordance with the ACL if a product is lost or damaged in transit. Title and risk of loss pass to you upon delivery to the carrier, subject to your consumer rights.

SECTION 6 - INTELLECTUAL PROPERTY

All trademarks, logos (including the name "Parrot Ripper Box"), and content are owned by Pixie Paws Pets. You may use the site for personal, non-commercial use only. You grant us a royalty-free license to use any photos or reviews you submit to us for marketing purposes.

SECTION 7 - RELATIONSHIP WITH SHOPIFY

Pixie Paws Pets is powered by Shopify. You acknowledge that Shopify is not responsible for any aspect of sales between you and us, including any injury or loss resulting from products. You release Shopify from all liabilities related to your transactions with us.

SECTION 8 - LIMITATION OF LIABILITY

Subject to the Consumer Guarantees in Section 1: In no case shall Pixie Paws Pets, our staff, or Shopify be liable for any injury, loss, or claim arising from your use of the service or any products. Our liability is limited to the maximum extent permitted by law in the State of Queensland.

SECTION 9 - DISPUTE RESOLUTION & FORCE MAJEURE

  • Disputes: If a dispute arises, you agree to notify us in writing and allow 14 business days for a response before initiating any legal proceedings in Queensland.
  • Force Majeure: We are not liable for delays caused by events outside our control (e.g., floods, cyclones, or strikes).

SECTION 10 - GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland.
